The law, which determines the annual rent increase rate in residences as maximum 25%, entered into force. Between 11 June 2022 and 1 July 2023, the rate of increase that can be made in rental prices is determined as 25% at most, regardless of the CPI.

Lawyer Nevin Can stated that both house prices and rent prices increased in a short time in the economic situation in the country and said that the tenants are in an increasingly difficult situation when the landlords want to raise the rents of the former tenants at a high rate.

Lawyer Can said, “According to the previous regulation, the agreements between the parties regarding the rent increase rate are valid, but the highest increase that can be made according to the Turkish Code of Obligations was the Consumer Price Index, that is, the twelve-month average in the CPI, as it is more commonly known, in the previous rental year. . CPI WILL RISE FURTHER

Lawyer Nevin Can gave the following information: “Taking into account these developments, the parliament took action and the law, which determined the highest rate of increase that can be made in the rental prices of housing as 25% in the coming period, regardless of the CPI rate, was published in the Official Gazette and entered into force. Accordingly, the maximum increase that can be made before June 11 was 39,33% according to the CPI, and now it is 25%. Therefore, the agreements between the parties regarding the rate of increase in the rental price are valid as long as it is below 25%, but if the parties agree or do not make an agreement to increase the rate of increase in the CPI or at a higher rate, the rental fees will be paid up to a maximum of 1% until July 2023, 25. It can be increased by XNUMX percent. While it is no doubt that this legal change, which was made to fix the increase that can be made in rental prices at least to a certain extent, will relieve the tenants a little in the economic crisis we are in, our hope is that the economy will recover as soon as possible.
