The Regulation on the Export and Import of Certain Harmful Chemicals, prepared by the Ministry of Environment, Urbanization and Climate Change, was published in today's Official Gazette.

The regulation was prepared for the effective implementation of the “Rotterdam Convention on the Procedure of Acceptance with Prior Notice in the International Trade of Certain Hazardous Chemicals and Pesticides”, to which Turkey is a party, and to comply with the relevant regulation of the European Union. Accordingly, with the regulation, protection of human health and the environment from the effects of harmful chemicals and for this purpose the use of harmful chemicals in an environmentally friendly manner, facilitating the sharing of information about the qualities of these chemicals, joint responsibility and cooperation between the parties to the contract and other countries in the national decision-making processes regarding import and export. Industrial chemicals, plant protection products and biocidal products, for which Turkey has taken prohibition/restriction measures at the national level, are also listed in the regulation, which also outlines the obligations imposed on exporters by the Ministry of Environment, Urbanization and Climate Change.

Software system will be created

A software system will be created for the submission of import and export notifications within the scope of the regulation. The system will contain data based on the annual reports submitted regarding the import and export transactions of chemicals within the scope of the regulation.

The regulation also obliges companies that export or import harmful chemicals to provide information to the Ministry in the first quarter of each year (until March 31) about the amount they export or import. An annual list of each chemical exported by the Ministry and the names of the parties or other countries importing this chemical will be prepared and this list will be made available to the public on the website.

The regulation will come into effect after 6 months.
