The regulations made by the Ministry of Environment, Urbanization and Climate Change on the "Restriction of the Use of Certain Harmful Substances in Electrical and Electronic Equipment" and "Management of Waste Electrical and Electronic Equipment" came into force after being published in the Official Gazette. In order to contribute to the protection of human health and the environment, including the environmentally friendly recycling and disposal of waste electrical and electronic equipment, the procedures and principles regarding the restriction of the use of harmful substances in electrical and electronic equipment have been redefined. In this context, electronic goods manufacturers will organize take-back campaigns and announce them on social media at least once a year, regardless of brand and model, for the efficient collection of waste electrical and electronic goods. Manufacturers supplying electrical and electronic goods to the market by manufacturers not established in Turkey will appoint an authorized representative to Turkey. With the arrangements made, it is aimed to collect and transport waste electrical and electronic equipment to processing facilities in a more efficient and environmentally friendly manner.
The Ministry of Environment, Urbanization and Climate Change, on the use of electrical and electronic goods, which are increasing in variety and usage area day by day and accordingly causing rapid and high amounts of waste, "Restriction of the Use of Some Harmful Substances in Electrical and Electronic Equipment" and "Waste Electrical and Electronic Equipment". Management” redefined its regulations. After the regulations made by the Ministry, a statement was made about the changes in the regulations published in the Official Gazette today. In the statement, it was noted that in order to contribute to the protection of human health and the environment, regulations were made for the application of circular economy principles in all processes of electrical-electronic goods, starting from the design, production, placing on the market and waste management.
“Manufacturers will prioritize using recycled materials in new design products”
The “Waste Electrical and Electronic Equipment Management Regulation”, which aims to protect the environment in a sustainable way, has been rearranged within the framework of harmonization with the European Union (EU) legislation, taking into account national-scale strategies and policies.
Manufacturers supplying electrical and electronic goods to the market by manufacturers not established in Turkey are obliged to appoint an authorized representative to Turkey.
During the design and production of electrical and electronic equipment, manufacturers have been given obligations to easily disintegrate, separate, prepare for reuse and recover products after they become waste. With the new regulation, manufacturers are obliged to use materials and parts that will facilitate their recycling and recovery, as well as to give priority to the use of recycled materials in new design products, if technically appropriate. Producers will announce to the public at least once a year, regardless of brand, model, manufacturer and content, through appropriate communication channels, including social media, by organizing take-back campaigns for household waste electrical and electronic goods, either individually or in cooperation with distributors.
“The obligation to obtain an 'Environmental License' has been brought to the transfer points”
It was also stated in the Ministry's statement that the "Transfer Centers" in the current regulation were reorganized as "Transfer Points" and the obligation to obtain environmental licenses was introduced.
The "transfer centers", which are included in the Regulation on the Control of Waste Electrical and Electronic Equipment, were rearranged as "transfer points" and the obligation to obtain environmental permits and license certificates was introduced. With this regulation, it is aimed to collect and transport waste electrical and electronic equipment to processing facilities in a more efficient and environmentally friendly manner. The environmental licenses of waste electrical and electronic equipment processing facilities and reuse facilities will be given specifically to the electrical and electronic equipment categories within the scope of the said regulation. With this application, the criteria of the facilities that will allow the reuse of waste electrical and electronic equipment for the same purpose will be regulated, and a second useful life will be provided to the waste products within the framework of the circular economy vision.
In order to ensure that waste electrical electronic equipment processing facilities and re-use preparation facilities are established under the same conditions throughout the country, waste electrical electronic processing facilities are in the "TS 13615 - Rules for waste electrical and electronic equipment processing facilities" standard, and new use preparation facilities are in the "TS EN 50614- Waste Requirements for the Re-use of Electrical and Electronic Equipment” was required to meet the conditions given in the standard.
“Measures will be taken in the recycling of electrical-electronic goods”
In the statement, it was emphasized that the production, collection and processing of electrical goods will be followed by the Ministry, and necessary measures, including restrictions and prohibitions, will be taken.
The Ministry has determined the procedures and principles regarding the restriction of the use of dangerous substances in electrical and electronic goods in order to contribute to the protection of human health and the environment, with the "Regulation on the Restriction of the Use of Certain Harmful Substances in Electrical and Electronic Equipment" within the framework of harmonization with the current European Union (EU) legislation.
Restricted substances were included in electrical and electronic goods, including cables and spare parts for the repair, reuse, updating of functions or increasing the capacity of these electrical and electronic goods. It was stated that the market surveillance and inspection of electrical and electronic goods within the scope of the regulation will be carried out in accordance with the provisions of the "Framework Regulation on Market Surveillance and Inspection of Products", which was put into effect with the President's Decision dated 9 July 2021 and numbered 4269.
It has been reported that the issues regarding the restricted substances in electrical and electronic equipment and the maximum permissible concentration values of these substances in certain situations have been determined.
