Regulation on Environmental Management Services Published in the Official Gazette

The Regulation on Environmental Management Services was published in the Official Gazette dated November 1, 2022, prepared by the Ministry of Environment, Urbanization and Climate Change. In the regulation, the term “environmental officer” was removed within the scope of Article 7410 of the Law No. 4 on the Amendment of the Environment Law and Some Laws. In the new regulation, which imposes the obligation of "Letter of Conformity for Location" to enterprises, the condition that the contracts to be made between enterprises and companies is made on the basis of the "Minimum Price Tariff" determined by the Ministry has also been redefined. With the amendment made, matters such as the quality and quantity of the personnel providing environmental management services and environmental consultancy firms, working conditions, consultancy fees, employment of new graduates were regulated. In addition, with this regulation, additional criteria were introduced for 674 existing environmental consultancy firms and new companies to be opened in the field of environmental management services.

The Ministry of Environment, Urbanization and Climate Change amended the Regulation on Environmental Management Services. With the amendment made, the term "environmental officer" was removed with the 4th article of the Law on Amending the Environment Law and Some Laws.

In the statement of the Ministry, it was stated that the Regulation on Environmental Management Services dated 30 July 2019 and numbered 30847 was repealed, and the new regulation was published in the Official Gazette on 1 November 2022 and entered into force. In this context, it was stated that the regulation was amended in order to reflect the amendment made in the law to the regulation and to increase the service quality.

With the new regulation that came into force, it was also stated in the Ministry statement that matters such as the quality and quantity of the personnel providing environmental management services and environmental consultancy firms, working conditions, consultancy fees, employment of new graduates were regulated.

In the statement of the Ministry, additional criteria for the existing 674 environmental consultancy firms and new companies to be opened in the field of environmental management service are listed as follows:

– Prior to the environmental consultancy firm's adequacy certificate applications, the "Location Compliance Letter" requirement was introduced, stating that the physical conditions of the firm's office are suitable.

– In order to standardize the service price to be paid by the enterprises in return for the environmental management services provided to the enterprises by the environmental consultancy firms, and to prevent unfair competition between the service providers, it was stipulated that the contracts to be made between the enterprises and the firms be made over the minimum price tariff determined by the Ministry.

– The number of personnel to be employed in the company has increased, thus paving the way for the employment of new graduates.

– According to the importance of the environmental impact of the non-compliance with the environment that will occur in the enterprise, it is obligatory to eliminate it within 90 days at the latest.

– Provisions were added to increase the quality of environmental management service by ensuring that the personnel only work within the scope of environmental legislation in the company they work for.
