In the case where Muhammed Burak Özdemir, known as CZN Burak, and his father İsmail Özdemir were on trial for "causing zoning pollution" on the grounds of the arrangement he made in the winter garden of his restaurant, a decision was made to dismiss.

Muhammed Burak Özdemir, who was on trial pending trial, and his lawyers attended the hearing at the Istanbul 34th Criminal Court of First Instance. The other defendant, İsmail Özdemir, did not attend the hearing. Burak Özdemir's mother, Didem Bozbura, also followed the hearing from the audience section. Stating that the case in question was decided in 2018, the judge said that the decision was overturned by the 23rd Penal Chamber of the Istanbul Regional Court of Justice.

Defendant Muhammed Burak Özdemir stated in his identity inquiry that he is an operator and that his monthly income is 30 thousand TL. Özdemir, who said that he should attend university for his education status, demanded that the appeal decision be complied with.

The judge asked, “Did you remove the place in question?” Upon the question of the defendant Özdemir, “The top and sides of the winter garden, which is the subject of the report, have been made open. I know it has been reinstated. Since I have been abroad for a long time, Mr. Ismail is interested in it, I got the latest status information from him. I demand my acquittal.” Their lawyers said, “The place in question has been reinstated. This structure is also documented with the holiday report. It is also not a place in the Bosphorus area. First of all, he should be acquitted, otherwise he should be dismissed as the violation has been resolved.”

In his opinion on the merits, the prosecutor of the hearing stated that although the defendants were prosecuted for violating the Law No. 2863 on the Protection of Cultural and Natural Assets and the Law No. 2960 on the Bosphorus, their actions remained within the scope of the crime of “causing zoning pollution” in the Turkish Penal Code and that the subject of the case was reinstated. Evaluating that the defendants were brought in, he demanded that a decision be made for the defendants to be dropped separately. Defendant Özdemir stated that he agreed with the opinion of the prosecutor and asked for a decision to fall.

The court decided to abide by the reversal decision of the appellate court. Considering that the subject of the case is outside the front view area and only in the affected area, the court stated that the actions of the defendants did not fall within the scope of the crime according to the relevant laws. Taking into account the reinstatement of the business in question, the court decided to drop the defendants separately.

Upon the question of the members of the press after the hearing, Burak Özdemir said, "There is nothing, there is no decision. A lawsuit has been filed by the municipality regarding the construction of awnings related to the restaurant. We came and gave our statement. There is no problem, everything is fine," he said. “Are you on trial with your father?” To the question, CZN Burak Özdemir said, “Don't judge or something, we just talked about it, there is nothing. Calm down,” he replied. Özdemir's lawyer, Sinan Adar, said, "There was a lawsuit for causing zoning pollution, it was decided to drop it." Özdemir said, "I was afraid when I suddenly lifted the camera, what happened?"
