The final steps are being taken in the regulation on the transition of contracted personnel, who have been in the work list of the Ministry of Labor and Social Security for a while, to the staff. With the last minute statement from Minister Bilgin, the details of the contracted staff became clear and the scope was determined. WHO IS INCLUDED IN THE CONTRACTUAL STAFF?

Vedat Bilgin, Minister of Labor and Social Security, made the following statements regarding the contracted staff in his latest statement: “We will hold a final meeting this week regarding the regulation. Our work will take its final form. There will be only 4Bs in scope”

Minister Bilgin had previously described the work with these words: “We will reduce all contract types in the public sector to a single type, except for special cases. We will give all the rights of public officials to them and we will allocate staff. I anticipate that we will finish this work by the end of this month.”

It has come to an end with the recruitment of approximately 600 thousand personnel working under contract in the public sector. After the completion of the technical study, a decision will be made regarding the two draft texts prepared. In this context, the Minister of Labor and Social Security Vedat Bilgin and the Memur-Sen administration met at the Ministry recently to make the final evaluations. At the meeting, it was learned that the Memur-Sen management would present their reports on the staffing to the contractors and expressed their demands in this regard.

Continuing its work on subcontracted workers, EYT, temporary and seasonal workers, the Ministry of Labor and Social Security continues the process of recruiting around 550 thousand contracted personnel in the public sector.

WE WILL RECEIVE ALL RIGHTS AND ALLOCATE STAFF

Vedat Bilgin, Minister of Labor and Social Security, said that they will reduce all contract types in the public sector except for special cases to one type, "We will give them all the rights of public officials and we will allocate staff." said.

At this point, it will be possible to simplify the contract system, which is especially fragmented in the public sector, and to grant staff rights. When needed in certain areas, a contracted system will be operated again. However, the contracted personnel system will no longer be a main employment area.

WHAT FORMULAS ARE ON THE TABLE?

A framework law proposal is being prepared on contracted personnel to be employed in Public Institutions and Organizations.

With the draft proposal, the terms of service, qualifications, employment and termination of employment, duties and authorities, rights, obligations and responsibilities, wages and other payments and personal affairs of the personnel to be contracted with the service contract will be regulated.

The terms of service spent in contracted positions of those who will be appointed to civil servant positions, provided that they do not exceed the degrees they can be promoted according to their educational status, will be evaluated in the determination of their earned rights monthly degrees and levels. They will be entitled to the financial and social rights of their appointed staff as of the beginning of the month following the date of their appointment. There will be no set-off for the financial and social rights they received in their previous positions. The total service periods spent in contracted positions will be taken into account in the calculation of the total service period based on the retirement bonus to be paid in accordance with the Turkish Republic Retirement Fund Law No. 5434.

According to the provisions of the Law on Family Medicine Pilot Practice dated 4924/24/11 and numbered 2004, while working in accordance with the Law No. 5258, the provisions of this article are applied to those who work in family medicine practice without having to resign.

After 01.01.2023, they will be employed as contracted personnel in the public sector. They will actually work in the provinces and positions they are assigned for 3 years. At the end of the 3-year period, if they apply within 30 days, they will be appointed to the positions with the title of civil servants.

At the end of the 3-year period, the contracts of the personnel who do not want to switch to civil servant positions will be deemed to be extended for another 3 years.

Contracted personnel will also be given the same rights as civil servants, such as spouse status and relocation due to health.

The terms and qualifications of the contracted personnel, Service contracts, and their financial rights will be regulated by this law.
