Another step has been brought to the administrative fine given to vehicle owners who are found to have passed without paying the specified fees on highways and roads where access control is applied.

Accordingly, those who pay within the first 15 days will not be penalized, while those who pay within the next 30 days will pay 1 times an administrative fine. The administrative fine to be applied to those who exceed this period will be 4 times. The application will be valid for non-paid passes made on and after 5 May 45, which covers 21 days before 2022 July, when the law enters into force.

The “General Communiqué on Collection” on the administrative fines to be imposed on the owners of vehicles that pass free of charge from the highways under the responsibility of the General Directorate of Highways and the highways where access control is applied has been published in the Official Gazette. Accordingly, the penalties to be given to vehicle owners who are found to have passed without paying a fee have been rearranged and a level has been brought.

Accordingly, an administrative fine will not be imposed if the toll fee is paid within 15 days following the grace period by vehicle owners who are found to have crossed without paying the toll fees determined for the highways operated by the General Directorate of Highways (KGM) and the highways where access control is applied. This provision was also included in the current regulation.

Pursuant to the intermediate stage introduced by the new regulation, an administrative fine in the form of four times the administrative fine will be applied if the toll fee is not paid within 15 days (ie within 30 days from the date of penalty) following the 45 days following the penalty date.

After the notification regarding the non-payment of the toll fee within the periods specified in the Communiqué, 4 percent of the administrative fine, which is four times the toll fee, and 25 percent of the administrative fine will be waived if the toll is paid. In addition, the cash payment discount in the sixth paragraph of Article 75 of the Misdemeanor Law No. 5326 will not be applied to the administrative fines paid in this way.

EXPLAINED WITH EXAMPLE

An example of the implementation was also included in the General Communiqué on Collections. The sample application is explained as follows:

“Example: On 5/7/2022, the highway, which is under the operation of the General Directorate of Highways, was passed without payment.

For payments to be made within 15 days (last day 20/7/2022) following the grace period, only the toll fee will be paid. If the toll fee is not paid within 15 days, the owner of the vehicle should be fined 4 times the toll fee by the General Directorate. However, if the payment is made within 15 days (30/21/7-2022/19/8) following the 2022-day period, the administrative fee amounting to 6001 times the toll and the toll fee, pursuant to the amended first paragraph of Article 30 of the Law No. 1. penalty will be charged.”

NO REFUND

According to the provisional article of the Law on the Services of the General Directorate of Highways, the amounts collected before the effective date of this article will not be refunded.

If any of the toll fees or an administrative fine of one multiple of the toll fee is not paid within 15 days following the 30 days following the grace period, the provision of the article will not be utilized.

The application will be valid for non-paid passes made on and after 5 May 45, which covers 21 days before 2022 July, when the law enters into force.
