Real Estate Sales Can Now Be Made by Notary Publics

With the law published in the Official Gazette dated 28 June 2022, the Notary Law was amended, allowing notaries to make real estate sales contracts.

Lawyer Nevin Can said that after the documents such as the title deed registration sample were shared with the notary publics by the Land Registry Offices, the notary publics could draw up a real estate sales contract between the parties after they questioned restrictions such as lien on the real estate.

Lawyer Can gave the following information on the subject: “Following the addition of the sales contract signed by the parties to the land registry information system by the notary public, the new owner of the immovable will be registered in the land registry by the land registry offices and the sale of the immovable will be realized. From this transaction, notary publics will be able to receive only the title deed fee determined according to the value of the real estate and the notary fee between 500 and 4.000 TL, which will also be determined according to the value of the real estate.
