The Regulation on the Demolition of Buildings prepared by the Ministry of Environment, Urbanization and Climate Change will enter into force on 1 July 2022. With this regulation; With the controlled and safe demolition of buildings, it is aimed to ensure the management of wastes after demolition in a way that does not harm the environment and human health.
The Ministry of Environment, Urbanization and Climate Change announced that the regulation on the demolition of buildings will enter into force on 1 July 2022.
In the statement, with the regulation published in the Official Gazette dated 13 October 2021 and numbered 31627, the transition period for the adaptation of the sector to the new rules was prepared by foreseeing; It was stated that it was aimed to ensure the controlled, safe demolition of buildings and the management of post-demolition wastes in a way that would not harm the environment and human health.
With this regulation; Excluding emergency demolition after disasters, demolitions to be made by administrations within the scope of the Zoning Law, and demolition of registered structures, demolition of all buildings and retaining walls that are subject to construction permits by demolition contractors who classify them as Y1, Y2 and Y3 according to their professional and technical qualifications and obtain an authorization certificate number from the Ministry declared to be mandatory.
Applications for Demolition Contracting Qualification System will be made to Provincial Directorates of Environment, Urbanization and Climate Change
Reminding that the applications of real and legal persons who want to be included in the Demolition Contractor Qualification System organized by the Ministry, will be made to the Provincial Directorates of Environment, Urbanization and Climate Change, it was emphasized that the demolition works will be carried out under the responsibility of the demolition contractor and the site chief, under the supervision of a technical responsible.
Information about the steps to be followed before the demolition process starts is explained as follows; “Before the demolition starts, demolition licenses will be obtained from the municipalities. The demolition license can be issued through the Spatial Address Registration System of the Ministry of Interior. The demolition plan, which is a kind of project of the demolition and explains what will be done before, during and after the demolition process, will be prepared under the coordination of the civil engineer and the author with the contribution of different professional disciplines. The demolition plan will specify which measures will be taken to ensure traffic safety and the structures that may be affected around the building, and which demolition technique will be used. The contractor will take safety and environmental protection measures before starting demolition activities. In controlled explosion demolitions, the Administration will inform the public, starting 7 days before, and make the necessary announcements and warnings, and ensure that law enforcement and emergency aid teams are present at the site. Demolition works will be carried out by selective demolition method. Materials that can be reused or recycled will be separated and recycled. Hazardous or non-recoverable wastes will be disposed of within the framework of the relevant legislation. Demolition works will have to be completed within 3 months after receiving the license.”
