Izmir Metropolitan Municipality announced that the objection process made with the European Bank for Reconstruction and Development (EBRD) regarding the construction tender of Buca Metro has been concluded and the objection has been rejected. The EBRD Complaints Committee Supreme Board stated that it has carefully examined and concluded that the complaint cannot be accepted. With this decision, the EBRD has approved the commission's decision on Buca Metro.

Although the claimant's complaint is still in the evaluation stage and the process has not been finalized in this sense, an action for annulment of the transaction has also been filed in the Administrative Court.

In this process, the objection of the plaintiff regarding the tender decision was evaluated independently at the EBRD and it was decided to reject the objection of the plaintiff as of 23.03.2022. The Procurement Complaints Review Directive states that the EBRD's final decision is final and not subject to appeal.

Although Izmir Metropolitan Municipality is completely bound by the law and judicial decisions, the said decision, which was given as a result of incomplete and insufficient examination by the court, will be appealed to the Council of State with a request for a stay of execution and a hearing within 15 days.
