FIRST PART

Purpose, Scope, Basis and Definitions

Goal

ARTICLE 1 - (1) The purpose of this Regulation is TCDD Taşımacılık A.Ş. To organize the organization, duties, powers and responsibilities and working procedures and principles of the General Directorate of Inspection Board.

Organization, Duties and Powers

Establishment of the Board of Inspectors

ARTICLE 5 - (1) The Board of Inspectors; It consists of the president, chief inspectors, investigators, assistant inspectors, Branch Manager and office staff.

Organization and commitment

ARTICLE 6 - (1) The Board of Inspectors is directly linked to the General Manager. The chairman performs his duties, while the inspectors carry out inspections, investigations and investigations on behalf of the General Manager.

(2) All functions of the Board of Inspectors in writing, accounts, archives, libraries and similar affairs and in the computing environment shall be carried out by the Branch Directorate under the Chairmanship of the Inspection Board.

Mission Center

ARTICLE 7 - (1) The duty center of the Board of Inspectors is Ankara. This center is also the duty center of the investigators.

(2) The Inspection Board may establish duty centers in the regions requiring the presence of inspectors in order to ensure continuous inspection and supervision by obtaining the approval of the General Manager.

Duties of the Board of Inspectors

ARTICLE 8 - (1) The duties of the Board of Inspectors are as follows:

a) To determine the principles of implementation at the General Directorate in line with the general principles adopted for the effective conduct of inspection, to develop methods and techniques for inspections, investigations and investigations to be carried out by the inspectors, to ensure the establishment of standards and principles, to prepare audit manuals, to increase the effectiveness and efficiency of inspections. to develop a system of inspections, to provide opinions and recommendations on this issue and to encourage the efficient work of the staff.

b) To carry out all kinds of inspections, investigations and investigations in the central and provincial units of the General Directorate.

c) To make proposals about the manner of implementation of the legislation on the duties of the Directorate General and the deficiencies and deficiencies identified.

d) To contribute to the more effective realization of the activities carried out by the General Directorate in accordance with the objectives and objectives, to produce solutions to the problems encountered in the application, to evaluate the effectiveness of the Head Office policies, to provide alternative suggestions by making analyzes on the application methods and results, to ensure that new policies are understood by the Head Office units In order to do studies.

Appointment of the Chairman of the Board of Inspectors

ARTICLE 9 - (1) An appointment is made to the Chairmanship of the Inspection Board among the inspectors who have at least 5 years of inspector service including the assistant inspector in the Inspection Board.

Duties, Authorities and Responsibilities of the Chairman of the Board of Inspectors

ARTICLE 10 - (1) The Chairman has the capacity and authority of the inspector and performs the following duties:

a) To carry out the duties specified in the article 8 on behalf of the General Manager with the order and approval of the General Manager.

b) To manage the Inspection Board and to supervise and supervise the work of the Inspector and Branch Office personnel.

c) Inspecting, investigating and conducting investigations as necessary.

ç) Preparing the Annual Inspection Program and submitting it to the approval of the General Manager and ensuring the implementation of the program.

d) To examine the reports from the inspectors, to ensure the elimination of any deficiencies, to evaluate the inspection, inspection and investigation reports, to present the Presidency opinion to the approval of the General Manager and to send the approved reports to the relevant units of the General Directorate, to follow the measures to be taken and the results of the actions to be taken and make recommendations.

e) To encourage inspectors to carry out scientific studies related to their profession, to enable inspectors to do research and research in Turkey and abroad, to increase the knowledge of vocational, general culture and foreign languages, to organize in-service training, courses, seminars and meetings, to inspect and audit to participate in national and international certificate programs related to their services.

f) To take the necessary measures to recruit assistant inspectors and provide them to be trained during the three-year assistance period.

g) To take necessary measures to ensure the unity of opinion and implementation in cases where the legislation is interpreted differently between inspectors.

ğ) To make proposals to the General Directorate on the issues that fall within the scope of duty, the lack of legislation in the applications and the issues related to the shortcomings, by conducting research and / or conducting research, and on the measures to be taken.

h) Ensuring the preparation and implementation of guidelines and instructions for ensuring the unity of implementation of the entire field of activity of the Board of Inspectors.

ı) To perform other duties related to inspection services by the Directorate General.

Assistance to the Board of Inspectors

ARTICLE 11 - (1) The Chairman may appoint a sufficient number of inspectors to assist him as the accompanying inspector with the approval of the General Manager.

Supervisory Board Chairman

ARTICLE 12 - (1) When the chairman leaves the office for temporary reasons, he / she shall assign the attorney's duty to one of the accompanying investigators, if the companion inspector is not appointed or if he is unable to fulfill his duty for temporary reasons.

The duties, authorities and responsibilities of inspectors

ARTICLE 13 - (1) Investigators on behalf of the General Manager;

a) To conduct inspections, inspections and investigations in the Company's production and service units and other operating fields related to the Company by means of inspection programs or non-program instructions and to present the result to the Presidency,

b) Inform the President at the time of the inspection, inspection and the acts which he / she has seen or learned during the investigation,

c) In case of the execution of duty, counting of all kinds of assets in kind, cash, securities and real estates given to the protection of the officers in the central and provincial units of the Company and all kinds of documents, files, documents and electronic, magnetic and similar information to obtain the originals of the documents by examining or retrieving the data in the processing environment, leaving the certified sample or photocopies,

ç) To remove the relevant personnel from the duty according to the principles stated in this Regulation,

d) To apply to the written or oral statements of the persons they deem necessary during their duties,

e) If necessary, from the workplace personnel of the relevant workplace staff, if they are required to return to work before the end of their permit, to ask the chief of staff to start their duty,

f) To request personnel from the competent chiefs of the Company's units to organize as an expert, to arrange the working place and program, to make recommendations to the Board of Inspectors when it is necessary to appoint experts from outside the Company,

g) If they are appointed in the scope of inspection, inspection and investigation initiated in the central and provincial units of the Company, in case they deem necessary, to transfer the information and documents related to the previous works and to submit the report to the Presidency,

ğ) To provide training for assistant inspectors who are accompanied, and to inform the Presidency with confidential letter about their work, efficiency, attitudes and behaviors,

h) During the inspection, investigation and investigation, to make recommendations for the elimination of failures and shortcomings in terms of the principles and principles of managerial and management and to make the works more regular,

ı) To carry out other duties to be given by the Presidency,

(2) Inspectors are responsible for the studies they have prepared and the reports they prepare.

(3) It is possible for assistant inspectors to use these powers or to be able to perform their duties independently.

ARTICLE 14 - (1) Inspectors work on the orders and approval of the General Manager with the instructions they receive from the Chairman of the Inspection Board and use the powers given to them in this Regulation on behalf of the General Manager wherever they are assigned.

(2) The General Manager may delegate the authority to appoint it to the Chairman of the Board of Inspectors by determining its limits and issues.

(3) Inspectors cannot be ordered from anywhere except the General Manager and the Chairman.

Compliance with inspectors

ARTICLE 15 - (1) Investigators;

a) Where they do not behave in such a way as to discredit the dignity and trust required by their duties and adjectives,

b) Not to interfere with execution,

c) annotation on documents, books and records, and not to make any corrections,

(d) not establishing special relations with persons subject to inspection or investigation, except as required by human relations;

d) Not disclosing confidential information and documents that they have acquired due to their duties, tasks and duties;

e) Notifying the Presidency of their arrival and departure to the places they are going for inspection, inspection and investigation,

f) Providing information to the Presidency by noting that the inspection, inspection and investigation works shall not be interrupted, delayed and carried out regularly, and also stated their reasons for the works that cannot be completed and

g) Notifying the Presidency of the situation if the result of the works they started depends on the examination and investigation in other places,

Assurance of Inspectorate

ARTICLE 16 - (1) Since the inspection services are arranged as a separate career from other administrative duties, inspectors cannot be dismissed or assigned to other administrative positions unless they are determined by their own willingness or incompetence with the requirements of the inspection services.

(2) Sanitary, moral or occupational disability; judicial decision, health board report, inspector report, such as documents are essential.

Dismissal

ARTICLE 17 - (1) Investigators;

a) It is inconvenient to remain on duty,

(3) The dismissal shall be notified immediately to the General Manager, the Chairman of the Board of Inspectors, the authorized officer of the appointment and the other concerned by the inspector.

(4) The dismissal measure taken for the personnel who is not required to be dismissed or disciplined at the end of the inspection and investigation shall be immediately removed by the authorized officers upon the letter or report to be given by the inspector.

Joint studies

ARTICLE 18 - (1) If more than one inspector is appointed for inspection, investigation and investigation, the coordination of the works is provided by the most senior inspectors. In the event that accompanying inspectors appointed with the assistance of the president take part in joint works, the group coordinator is the accompanying inspector.

The completion of the work and the transfer of work

ARTICLE 19 - (1) Investigators complete the tasks given to them within the time specified by the Board of Inspectors. They inform the Presidency of the Board of Inspectors in time about the works that cannot be completed in time and act according to the instructions they will receive.

(2) It is essential that the work given to the inspectors is not transferred. If the transfer is born; the inspectors may assign their works to another inspector by the instructions of the President.

(3) If the circuit is started, the inspector will transfer all documents related to the work done until the date of the transfer, together with the summation of all documents related to the work, and only the work documents that are submitted to him / her on the job if he / she has not started.

Duties, Authorities and Responsibilities of the Branch Manager and Office Personnel of the Inspection Board

ARTICLE 20 - (1) Branch Office consists of a Branch Manager and a sufficient number of staff under the order of the Chairman of the Inspection Board.

(2) Branch Manager and office staff in accordance with the orders of the Board of Inspectors;

a) To carry out all kinds of transactions and communications in accordance with the orders,

b) Storing the remaining reports, copies and communication documents in the Inspection Board on a regular basis,

c) To make the necessary division of labor among the branch personnel,

ç) To ensure the distribution of orders without delay,

d) To carry out the personal transactions, progress payments and other administrative and monetary services of the personnel of the Department of Inspectors and Branch Office,

e) To carry out the procedures related to stationery, printing and other materials of the Inspection Board,

f) To carry out the tasks stipulated in the legislation and other duties to be given by the President,

is authorized and authorized.

(3) Branch Manager and Branch Manager personnel cannot disclose the information they have acquired due to their duties. The Director of the Branch is responsible to the President for ensuring that the duties are carried out indefinitely, the office is regularly operated, and the confidentiality is ensured.

Inspector Assistant Exam, Proficiency Exam, Inspector

Training and Appointment

Introduction to Inspectorate

ARTICLE 21 - (1) To have received the base score of the KPSS score type or types that are not valid for the inspector profession only in TCDD Taşımacılık A.Ş. Deputy Inspector is entered as Deputy Inspector provided that he / she pass the entrance exam.

(2) Entrance examination consists of two stages, written and oral. Those who are not successful in the written exam are not allowed to take the oral exam.

(4) The Inspection Board cannot be taken to the Inspection Board either openly or in cash, or in any other way by the chief inspector, inspector or assistant inspector. This provision shall not apply to the Board of Inspectors who have entered the Inspection Board in accordance with the provisions of this Article and shall be re-appointed from the inspectors who have left the Inspection Board for various reasons.

Entrance examination requirements

ARTICLE 22 - (1) In order to take the entrance examination;

a) to carry the qualifications stated in paragraph (A) of the first paragraph of the article 14 of the Civil Servants Law numbered 7 / 1965 / 657 and 48,

b) Not to be at the age of 35 as of the first day of January of the exam,

c) To be graduated from the faculties of law, economics, political science, business administration, economics and administrative sciences which have at least four years of undergraduate education, or from the educational institutions in Turkey or abroad whose equivalence is accepted by the Council of Higher Education,

ç) Having obtained the minimum score from KPSS score type or types determined by the Presidency,

d) to be among the applicants from the applicant with the highest score, from the number of candidates determined by the Presidency (including other candidates with the same score as the last candidate), starting from the one with the highest score;

Entrance exam

ARTICLE 23 - (1) Dates, dates and places of entry exams are published in the Official Gazette and the State Personnel Presidency and the corporate website of the Company. Entrance exam announcement is made at least one month before the exam date.

(2) The application and registration period of the candidates are determined by the Presidency of Inspection Board and stated in the examination announcement.

Documents requested from the applicants

ARTICLE 24 - (1) Candidates who want to take the exam;

a) TC identification number statement,

b) Examination application form,

c) Company approved copy of the computer output of the KPSS result document,

d) The original copy of the diploma or graduation certificate or the Company approved copy,

d) Two photographs of 4,5 × 6 cm in the last year,

(2) Applicants who have already completed the written exam are required to submit the following documents before entering the oral exam:

a) Written statement that there is no obstacle to doing his / her job in a health condition.

d) Curriculum vitae with their handwriting.

d) Four photographs of 4,5 × 6 cm in the last year.

(3) Exam results are deemed invalid and assignments are made to those who are found to have misrepresented or submitted documents. Even if they are appointed, they are canceled and a criminal complaint is filed with the Office of the Chief Public Prosecutor on 26 / 9 / 2004 and the relevant provisions of the Turkish Penal Code numbered 5237.

Examination Board

ARTICLE 27 - (1) Exam Board is established with the participation of four inspectors under the Presidency of the President with the approval of the General Manager. In addition, the President appoints a sufficient number of substitute members from the investigators.

Written exams and evaluation

ARTICLE 28 - (1) Written exams are carried out according to the following principles:

a) Written exams shall be commenced at the place and hour announced and completed in a predetermined period of time. After the time set by the Examination Board, the students are not allowed to take the exam.

b) Candidates are taken to the hall by checking the entrance cards issued to them and the valid identity documents issued by the authorities.

c) Inspectors appointed by the Chairman and members of the Examination Board and the Board of Inspectors for this purpose are obliged to maintain the exam discipline, prevent copying and ensure that the exams are finalized without incident.

ç) The question envelopes are opened in front of the participants and the situation is determined by a minute.

d) After comparing the exam answer sheets, exam entry document and the name and number in the paper, the name part is collected by closing to the candidate and placed in an envelope. On the envelope, it is written how many papers are included in the exam, sealed with the seal of the Chairman of the Examination Board, signed by the Chairman and members, and the final status is determined by a minute.

e) At the end of each exam, the exam papers placed in the envelope by the Examination Board shall be submitted to the Chairman of the Inspection Board with the minutes.

f) Where necessary, measures shall be taken by the General Directorate for exam security.

(2) Written exam grade; It is the average of the grades taken from the written exam groups other than foreign languages. In order to be considered successful in the written exam, a minimum of 60 points must be obtained from each of the written exam groups other than the foreign language and their average must be at least 65.

Verbal examination, the subject of the examination and evaluation

ARTICLE 29 - (1) Candidates who are successful in the written exam, starting from the highest score and up to four times the number of positions specified in the entrance exam announcement, are invited to the oral exam with a letter with a receiving notice, by specifying the place, day and time. The notification and call is made by the Board of Inspectors.

(2) In the oral exam, each candidate is graded over the full score of 100 by the chairperson and members of the Examination Board. The arithmetic average of these scores constitute the oral exam grade.

(3) Oral examination, candidates;

a) The level of knowledge about exam subjects,

b) Comprehending and summarizing a subject, ability to express and reasoning power,

c) Qualification, representation ability, suitability of behavior and reactions to the profession,

ç) Self-confidence, persuasiveness and credibility,

d) General ability and general culture,

e) Openness to scientific and technological developments,

and evaluated separately.

(4) Candidates are assessed on the score of fifty points for the subparagraph (a) of the third paragraph of the third paragraph of the third paragraph, for each of the features written in (b) to (e).

(5) In order to be deemed successful in the oral exam, the grade obtained in this exam must not be lower than 65.

Objections to written and oral examination results

ARTICLE 30 - (1) Objections to written and oral exam results are submitted to the Presidency within 5 business days following the announcement of the exam results. Objections are examined by the Examination Board within 5 working days at the latest. The Examination Board shall attach the result of the examination to a report and submit it to the Presidency. The Presidency takes action according to the examination result.

Evaluation of entrance exam grades and appointment of assistant inspector

ARTICLE 31 - (1) Entrance exam grade is found by the arithmetic average of the grades obtained as a result of the written exam and the oral exam. In order to be considered successful in assistant inspector entrance exam, entrance exam grade must not be less than 65.

(2) If the number of students who succeeded in the exam is more than the number of staff, the ones with the entrance exams are preferred. In the case of equality of the entrance exam grade, the candidate who has a foreign language grade has the priority. If the number of students who pass the exam is more than the number of vacant vacancies, the candidate shall be considered as the candidate until the number of the announced vacancies and the number of the candidates announced according to the success ranking from the other candidates. For others, exam results are not considered granted rights.

(3) Exam results are determined by the Examination Board. Those who pass the examination are required by the Board of Inspectors. Candidates are required to apply to the Board of Inspection Board until the date specified in the announcement in order to carry out their procedures regarding the appointment.

(4) Assignment of the same entrance exam to the assistant inspector is done in order of rank in the exam. The results of the exams for those who have not yet taken the office within the statutory period, although the entry exam has actually been won and appointed, shall not be deemed a vested interest. They are assigned to successors according to their successes.

ARTICLE 32 - (1) In the training of assistant inspectors;

a) To develop their personalities according to the qualifications required by the profession,

b) To ensure that they gain experience and expertise in the legislation in force within the jurisdiction, inspection, investigation and investigation,

c) To gain the habit of benefiting from the innovations brought by scientific work and technology,

ç) To provide opportunities for the development of foreign language knowledge,

d) To be guiding and encouraging in order to enable them to participate actively in social, cultural and skills-based activities,

Breeding program

ARTICLE 33 - (1) Assistant inspectors are trained in the three-year assistant period according to the following schedule.

(2) First term studies:

a) In accordance with the General Regulation on the Training of Candidate Officials, which was put into force by the Council of Ministers Decree 21 / 2 dated 1983 / 83 / 6061, this period begins with the basic and preparatory trainings of the candidate office.

b) In this period, theoretical training shall be organized in order to teach the inspections, investigations and investigations in the scope of the Inspection Board Presidency, the regulations of the Company, the operations of the Company's operations and the assistant inspectors and the foreign language knowledge of the assistant inspectors. In the course of these trainings, the examination is carried out. As a result of these exams, the average score of 100 is taken as the first grade. The first term work is 6 month.

(3) Second term studies;

a) It shall be arranged in such a way as to enable the inspectors to learn the procedures and principles of inspection, investigation and investigation through the supervision of the inspectors.

b) Assistant inspectors are under the supervision and supervision of the inspector they are accompanied by. They perform the duties given to them according to the inspector's instructions. They cannot conduct investigations, inspections and investigations alone, nor can they make reports.

c) The work of assistant inspectors shall be arranged in such a way as to enable them to grow up in the best way possible by the inspectors they accompany.

ç) Assistant inspectors are given notes on the 100 full score by the inspectors they accompany. The average of these grades is considered as the second semester.

d) The second term is 1 year.

(4) Third cycle studies;

a) Deputy inspectors who have successfully completed their first and second semesters can be inspected, inspected and investigated by the Presidency of the Board at the end of 18 months. If the assistant inspectors are empowered, they have the duties, powers and responsibilities of the inspectors.

b) The assistant inspectors authorized for inspection, investigation and investigation shall act together with other inspectors or assistant inspectors when necessary.

c) The works of the assistant inspectors for the third period shall be arranged by the Chairmanship of the Inspection Board taking into consideration the completion of their upbringing.

ç) The third term study notes of assistant inspectors; All kinds of studies, inspections, investigations and investigations related to the inspections, investigations and investigations are determined by examining and evaluating the reports by the Qualifying Examination Board before the proficiency exam.

(5) For illness and other compulsory reasons, 3 will be extended as long as the periods of assistance of those who have not assisted have remained separate from their duties.

Expulsion from the Inspection Board

ARTICLE 34 - (1) During the assistant inspector, those whose attitudes and behaviors that are incompatible with the inspector's character and qualities are fixed, are transferred to another duty outside the Inspection Board without waiting for the proficiency exam.

Qualifying examination

ARTICLE 35 - (1) The assistant inspectors are subjected to a proficiency exam after a three-year training period.

(2) The current legislation and the application of this legislation in the field of duties and jurisdictions of the professors and the assistant inspectors; information on inspection, inspection and investigation methods; whether they gain other knowledge and qualifications required by the profession are measured.

(3) The proficiency exam consists of two stages: written and oral. Written exam, 38 is made from the exam subjects mentioned in the article. The assistant inspectors who are successful in the written exam are subject to an oral exam. The proficiency exam score is calculated and evaluated according to the principles stated in 40.

Exam announcement

ARTICLE 48 - (1) Within the scope of the Annual Inspection Program prepared by the Board of Inspectors and approved by the General Manager, inspections are carried out according to the principles in the program. Other appointments outside the program and other inspection activities that do not require the approval of the General Manager and tour duration of the inspectors are carried out in accordance with the Working Principles and Procedures of the Board of Inspectors determined by the Board of Inspectors.

ARTICLE 54 - (1) An inspection report is issued on matters including defects and deficiencies in the inspections and determining the procedures to be corrected by the relevant units, and the answers of the inspectors and the final opinion of the inspector regarding these responses and the general status of the unit.

(2) Although it is essential to issue a single inspection report for each unit, in case of necessity it is possible to issue an inspection report with separate answers for services or functions.

(3) Inspection reports;

a) The names, surnames and civil servants of the officers whose operations are inspected, the date on which they are examined from the date they are examined,

b) Which items of the legislation are incorrect and incomplete;

c) The report will be replied by the relevant persons within 15 days at the latest,

ARTICLE 58 - (1) It is a criminal, legal, legal and administrative evaluation of the status of the actions and actions that are deemed necessary by the Authority to be investigated in the face of the internal and external legislative provisions, which are determined during the inspections and investigations or that are notified by complaints and complaints. .

Investigation reports

ARTICLE 59 - (1) The investigation results of the personnel working in the central and provincial units of the Directorate General for the actions and procedures that constitute a disciplinary crime in accordance with the applicable penal legislation are linked to the investigation report.

(2) The investigators report the date and number of the investigation order, the elements of the investigation, the elements of the offenses and the provisions of the law on the offenders, and the disciplinary offense of the offenders.

(3) Inspectors shall prepare the investigation report and submit it to the Head of the Inspection Board after the investigation is completed.

(4) It is submitted to the Presidency of the Board of Inspectors in order to send a sufficient number of copies of the submitted investigation reports to the relevant places. However, the investigation report, which is prepared for an offense falling within the scope of Article 3628 of the Law No. 17, is sent directly to the Public Prosecutor by the inspectors, and a copy is sent to the Board of Inspectors without delay.

Reports to be made by the Board of Inspectors and central units on the reports

ARTICLE 60 - (1) Reports; The chairperson is examined by the escort inspector or by an inspector to be appointed. (2) In case the report is issued by more than one inspector and if there are differences of opinion about the results of the report among the inspectors, these differences are stated in the report. (4) Inspection reports are examined by the relevant central units at the latest within 15 days and the issues stated in the reports are sent to the inspected unit. The relevant central units shall inform the Board of Inspectors on 15 within the day of their transfer to the inspection reports.

(5) The transactions and results of the investigation and inspection reports shall be notified to the Board of Inspectors as soon as possible by the relevant central units.

ç) To respond to the questions to be asked within the 2 days at the latest in inspection, investigation and investigations,

(2) Investigators communicate directly with the Company's internal departments and authorities regarding inspection, investigation and investigation.
