The Ministry of Transport and Infrastructure is building metro and city rail transport systems for many municipalities, mainly in Ankara and Istanbul. The government is changing the law because it cannot collect the cost of its investments from the local authorities. The municipality will not be expected to take over the line when determining the amount of debt and the amount to be collected.

AKP lawmakers submitted a Law Proposal to Amend Some Laws and Decree Laws.

Some amendments are made to the Decree-Law on Some Regulations Regarding Transportation and Infrastructure.

MUNICIPALITIES DO NOT PAY PAYMENT

Article 15 of the decree stipulated the collection of the expenditures made by the central government due to the metro, urban rail transportation systems and similar projects.

However, in practice, although the municipalities took over the business and started to generate income, the Ministry of Transport and Infrastructure could not collect because it did not take over the ownership.

The government, unable to take its share from the revenue of the metros, will amend the regulation in question, linking the start of the collection from the projects to the condition of the transfer of the enterprise instead of the ownership condition.

Accordingly, after the completion of the ropeway, funicular, monorail, subway and urban rail transportation systems undertaken by the Ministry of Transport and Infrastructure, their ownership will be transferred to a municipality at cost.

PROJECTS TAKEN BY THE MINISTRY

In 2010, the Law on Organization and Duties of the Ministry of Transport and Infrastructure was amended and the city railways and metros were constructed by the ministry.

Ministry of Transport and Infrastructure, with subway lines "Kızılay-Çayyolu", "Batıkent-Sincan / Törekent" and "Tandoğan-Keçiören" in Ankara, Levent-Hisarüstü Metro Line, Bakırköy (İDO) -Bağcılar (Kirazlı) Metro Line undertook the construction of Gayrettepe - Istanbul New Airport Railway Connection and Sabiha Gökçen Airport Railway Connection. The Ministry also took part in the construction of Antalya-Meydan-Airport-Expo Tramway Project, Konya Rail System Line, Egeray in İzmir and Gaziray urban rail systems in Gaziantep.

THE PAYMENT PLAN WILL DETERMINE THE PRESIDENT

Municipal companies taking over the operation of the metro or city rail transportation line will pay the cost of the projects to the ministry every month until the debt is finished.

Within the framework of the principles and procedures determined by the President, the general budget tax revenues of the relevant municipality will be deducted from the total collection. The amount will be transferred to the account of the Ministry of Treasury and Finance.

In the event that the non-paid installment amounts in the maturity date are not paid within 25 working days after the due date with the accrued delay increase, the rate increase will be applied for each month in the amount of 4.

CLOSING IN OLD PROJECTS

This regulation shall cover the balance of the projects not already paid by the date of issue as of the date of publication of this article.

The amounts that have not been paid partially or completely within the scope of these projects before the publication date of this article will be transferred to the relevant account of the Ministry of Treasury and Finance at the Central Bank within 180 days from the date of publication of this article.
