In the complaint application, it was stated that it is not possible to carry out the tender work with 2 million 627 thousand 686 TL, and there are 408 work items in the specification. In addition, it was argued that the notary certified signature circular in the tender dossier, the Trade Registry Gazette, which indicates the status of the partners, members or founders of the legal entity, and officials under the management of the legal entity, were not submitted.


Evaluating the complaint, KİK determined that there were a number of regulations in the tender that were against the legislation, and decided that this situation could be corrected by corrective action. KİK decided to exclude the proposal of Kone Elevator Industry and Trade Inc. and to carry out the tender processes after this stage in accordance with the legislation.


At the beginning of the practices contrary to the legislation determined by the JCC decision, an extremely low bid description came first. In the JCC decision, according to the legislation, the components considered important in the proposal were determined by the administrations and it was reminded that the bidders whose proposals remained below the limit value should be asked to explain. However, in the inquiry letter sent by IETT, it was stated that it is requested to explain the costs that will include only the transportation, tax, insurance, painting and fee expenses, KIK share expense and tender contract expense components to be made in accordance with the legislation, without specifying the important lower cost elements. When the Technical Specification was examined, it was noted that IETT did not determine the important bid components according to the cost elements by emphasizing that there are many items such as labor, SCADA system, cleaning materials, equipment, tools, equipment costs, calibration expenses that may be a cost element for the 408 work items included in the price. In this context, it was concluded that it is not possible to make a healthy evaluation for excessively low bid inquiry.
