The report prepared by the chief inspector Lütfi Alpsoy, assistant labor inspectors Ayhan Mercan and Selahattin Cerrah about the accident that occurred in the viaduct numbered V-5 on April 35 and resulted in the death of workers Lütfü Bulut, Yaşar Bulut, Kahraman Baltaoğlu was completed.
In the 37-page report, the construction of the bridge and highway construction undertaken by ICA İçtaş-Astaldi partnership, the construction of the V-35 viaduct, where the accident occurred, was underlined by Ongun Construction and Design Industry Trade Company.
In the report, it was stated that workers Lütfü Bulut, Yaşar Bulut and Kahraman Baltaoğlu died as a result of the fall of the mold on one side of the head together with the concrete and the pier while vibrating and gauging the elevation head. "No lifeline system"
The 12 deficiencies identified in the 'non-compliance with the legislation that caused the accident' section of the report are as follows:
1 - The employer did not ensure the occupational health and safety of the employees.
2- The wall anchors of the remaining scaffold were found to be total 15 pieces, and they were connected to the elevation wall of the scaffold by anchoring anchored anchor and the closest to the first scaffold leg. As such, the scaffold is not capable of lifting the lateral load. The scaffold is not securely supported, and is not properly fixed against horizontal and vertical forces.

4- Connection and fixing points of the scaffold are not capable of meeting the static and dynamic forces caused by the load.
5- The base plates on the feet of the scaffolding that touch the floor do not have the base plates and the supports required to distribute the load.
6- No detailed control has been made about the scaffolds and no detailed report has been prepared.
7- There is no horizontal life line system to keep the employees in hanging and falling situations in case of mold and scaffold collapse.
8 - Horizontal life line and equipment were not determined in the health and safety plan and health and safety file of the project.
9- A qualified person has not been appointed by the employer to control and supervise the work at the height.
10 - The molds were not controlled continuously until the concrete pouring was completed, and the adequacy of the measures against the possibility of mold opening and explosion was not reviewed.
11- Regular, detailed control is not carried out as to whether the mold is suitable for the concrete formwork.
12- The mold of the head part is not to be integrated in itself and with the scaffolding connections.
14 thousand 560 lira fine
While the danger is not foreseen in the design and planning, the manufacturing is not made sound enough and the control is not ensured, it is stated that the responsibility of the employer is the responsibility of the accident. "It is not right to expect the state to inspect every viaduct"

During the inspection, it was reported that the viaduct 35, where the accident occurred, was also inspected, but since the construction of the head section was not started yet and the scaffolds were not installed, no determination could be made in this direction.
The report said:
“Employers are obliged to carry out all production according to occupational health and safety procedures and principles. It is not right to expect the state to inspect every manufacturing, every viaduct, every standing and to see this as a lack of control. In any inspection system in the world, there is no understanding or practice that there will be control for every part of the production. The state does not have employees in every workplace to be assigned for each production during the continuation of the activity. In addition, the opening of the head mold of the viaduct leg or the fact that the connections of the scaffold are not solid, it is not easily detected in the inspections carried out on behalf of the state.
"Low administrative fines applied"
Unal Demirtas, the lawyer of the dead worker brothers Lütfü and Yaşar Bulut, argued that the administrative fines imposed on the employer were low.
Demirtaş said, “The employer putting aside the work safety precautions in order to finish the job quickly and continuing the working system and wanting to gain excessive profit caused such an accident. The low administrative fines imposed also encourages employers. "Giving heavier penalties for occupational safety measures will help prevent such accidents."
